Terms & Conditions

These Terms & Conditions ("Terms") govern your use of Neon Kancil (the "Service"), operated by Anne Dream Ventures (202303320801) ("we", "us", "our"). By using the Service you agree to these Terms.

1. The Service

Neon Kancil is an AI-powered brand positioning tool. You provide answers to a questionnaire and receive an AI-generated brand strategy report. The Service is provided on an "as is" basis without any guarantee of uninterrupted or error-free performance.

2. Accounts

An account is required only to purchase a paid plan or manage a subscription. You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You confirm you are of legal age and, if signing up on behalf of a company, that you have authority to bind it.

3. Payments & Subscriptions

Payments are processed by Stripe. By subscribing, you authorise us (via Stripe) to charge the payment method you provide on a recurring basis for the plan you selected. Payment, billing and card-processing mechanics are governed by Stripe's Consumer Terms. Subscriptions renew automatically at the end of each billing period until cancelled. Cancellations take effect at the end of the current billing period; you retain access to paid features until then.

4. Acceptable Use

You must not use the Service to:

• Break the law, infringe intellectual property rights, or harass others.
• Attempt to reverse-engineer, probe, scrape or interfere with the Service.
• Transmit malware, spam, or attempt fraud.
• Generate illegal content, deepfakes of real individuals without consent, hate speech, sexual content involving minors, or content designed to defame.
• Attempt to jailbreak, prompt-inject, or circumvent the safety measures of the underlying AI models.

5. AI Outputs

AI-generated outputs may be inaccurate, incomplete, or unsuitable for your specific situation. You are responsible for your prompts, how you use the outputs, verifying accuracy, and having the rights to any input content you submit. Outputs are not a substitute for professional legal, financial, tax or regulated advice. To the extent allowed by law, you own the outputs generated from your inputs, subject to these Terms.

6. Intellectual Property

The Service, its software, branding and documentation are owned by Anne Dream Ventures and its licensors. Subject to these Terms and your active plan, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right to use the Service. You must not resell, redistribute or offer the Service to third parties without our written permission.

7. Content Moderation & Takedowns

We may remove or restrict content, refuse or filter outputs, and suspend accounts that violate these Terms. If you believe content on the Service infringes your rights, contact us and we will investigate promptly. Repeated infringement will result in termination.

8. Suspension & Termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, you may export data through the Service for a reasonable window before deletion.

9. Warranties & Liability

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability under or in connection with the Service is capped at the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, special or incidental damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Governing Law

These Terms are governed by the laws of Malaysia, and disputes are subject to the exclusive jurisdiction of the courts of Malaysia.

11. Changes

We may update these Terms from time to time. Continued use after changes constitutes acceptance. Material changes will be notified where reasonably possible.
